Texas Thc Laws & Penalties
THC is the psychoactive ingredient of the marijuana plant, which is responsible for giving users a high. THC products are categorized in Penalty Groups 2 and 2-A under Texas law.
Common types of THC products include:
- Edibles such as brownies, gummies, and candies
- Concentrates such as oils, hashish, and dabs
- Vape products
- Tinctures and sprays
- Topicals such as lotions and rubs
Possession of less than one gram of THC concentrate, extract, hashish, or oil is considered a state jail felony, which carries a maximum two-year prison sentence and a fine no more than $10,000.
Possession of between one gram and less than four grams is a third=degree felony, punishable by a prison term of up to 10 years and a maximum $10,000 fine.
Possession of between four grams and less than 400 grams is a second-degree felony, which can lead to a maximum 20-year prison sentence and a fine not exceeding $10,000.
Law enforcement officials may arrest someone for possessing CBD products or hemp oil, which is often confused with THC products. However, hemp and hemp-derived products are now legal since June 2019, as long as it doesn’t contain at least .3 percent THC.
Since the legalization of hemp, police departments throughout Texas have yet to develop testing equipment that determines how much THC is in a substance, which has resulted in many marijuana cases being thrown out.
