Getting a CPS visit can be one of the most challenging moments for parents who are going through custody battles. In some cases, the first instinct of a parent who gets a CPS visit would be to become overconfrontational and aggressive. Some parents do that to protect their children; meanwhile, other parents do it for their own selfish reasons. Regardless, being overconfrontational and aggressive will not do you any good. Which is why our first tip for parents is this:
Calm Down and Be Polite
When a CPS worker visits your home, the first thing they look for is overall safety and habitability of the house. One factor for that is the mental and emotional state of the parent. If they notice that you lack temperance or, worst-case scenario, are abusive, they might take away your custody of your child.
Another reason why it is helpful to be level-headed in this situation is that you need to be aware of what is going on. Meaning, you need to ensure that they have the authority and that they are not encroaching on your rights. Upon arrival, calmly ask for their names and purpose, double-check if they visited the right house, and document everything that transpired.
Cooperate, But Don’t be a Pushover
Although difficult, cooperating with the CPS is essential. Be honest when answering their questions and provide documentation when necessary. Also, if the CPS or the court had given you orders, make sure to comply. Your cooperation can help strengthen your cause.
However, when it involves your home and your children, do not immediately allow them to enter your home or interact with your children. Verify if they have the legal authority to do so. Always be aware of your rights and ensure that due process is followed during the entire visit, which now leads us to the last tip:
