All sex crimes are serious. Texas Penal Code Section 21 defines most sex crimes. Certain others, including sexual assault, are included in Section 22 as assault-related offenses.

The Texas rape law makes it a crime to engage in sexual conduct without the other person’s consent or by using physical force, violence or coercion. In technical terms, it is a crime to knowingly or intentionally engage in the following types of acts without the other person’s consent:

- Penetrating the other person’s mouth with your sexual organ
- Causing another person’s sexual organs to come into contact with, or penetrate, someone else’s sexual organs, anus or mouth
Rape is always a felony-level criminal offense. Sexual assault charges can be aggravated to a more serious felony under Section 22.021 of the Texas Penal Code if the prosecution can prove the actor committed sexual assault and any of the following additional factors were involved:
- The actor used a deadly weapon
- The victim suffered serious bodily injury
- The victim was threatened with imminent death or serious bodily injury
- The actor used a date rape drug
- Multiple people acted together in committing the sexual assault
Aggravated assault is a first-degree felony. If a child is involved, a mandatory minimum 25-year prison term may be imposed without the possibility of parole.
Child Pornography
Crimes involving child pornography are also considered sex crimes in Texas. Section 43.26 of the Texas Penal Code governs the possession and promotion of child pornography. Possession of child pornography requires the prosecution to prove:
- The actor knowingly and intentionally possessed visual materials or accessed them with the intent to view
- The visual materials depicted a child under the age of 18 engaging in sexual conduct
First-offense possession of child pornography is usually a third-degree felony.
If the defendant possessed the materials with an intent to promote them, the crime is elevated to a second-degree felony charge for first offenders. An intent to promote is presumed if the actor had at least six identical copies of the materials.
Indecency With A Child
In Texas, indecency with a child is a form of child abuse. A person commits indecency with a child who is younger than 17 when:
- The person engages in sexual contact with the child or causes the child to engage in sexual contact
- The person exposes the genitals or anus with the intent to cause sexual gratification or arousal and knows the child is present
- The person causes the child to expose the child’s genitals or anus with the intent to cause sexual gratification or arousal
Sexual contact includes any type of touching that is intended to cause sexual arousal or gratification. If actual touching or contact is alleged, the crime is a second-degree felony. If the state accuses the actor of improper exposure or exposure of the child, the crime is a third-degree felony.
Sexual abuse of a child is extremely serious. It is never a defense to say that the actor did not know the child’s age at the time.
Sex Crime Convictions Carry Harsh Penalties In Frisco, Tx
